Waiting for your visa: what is allowed?

The honest answer: the law is silent. South Africa’s Act does not cover your wait. No text gives you the right to stay. No text takes it away. Many people stay and wait. That is practice, not a right. We read the Act on 29 August 2026.

This page is for one moment. You already applied for more time. Not applied yet? First check your deadline. Late? Read: is it too late to apply?

What did you get when you applied?

You paid and got a receipt. The receipt shows you applied. It shows the date. That is real and useful. Keep it safe. But the law gives it no power. It is not a visa. It does not change your dates.

Can you stay after your visa ends?

Here is the exact state of the texts. We read the Act on 29 August 2026. For your case, more time on your visa: silence. No line about the wait at all. For a different case, the Act does speak. Changing to another visa type: no right to stay. That line is section 10(8). It is not about your case. We will not stretch it either way.

So no text gives you the right. And no text takes it away. Many people stay and wait for the answer. That is practice, not a right. Home Affairs decides.

Does waiting pause the overstay clock?

No text we read pauses it. The count starts when your visa ends. The law says that. Its line is regulation 27(1). An application does not stop it. A receipt does not stop it. What can the clock lead to? Read the worst case.

Can you leave South Africa while you wait?

The texts answer one case only. It is Form 20. Form 20 is for people whose visa already ended. Home Affairs let them stay and wait. The form’s own text gives a warning. Leave before the decision? Then you are listed as undesirable. That is the form’s text, for its holders. For a plain extension wait, no text answers. We will not guess. Read the full story: can you leave while you wait?

How long is the wait?

No official number exists. VFS’s own page says times vary. We read that on 29 August 2026. We will not invent a number. Any site that promises weeks is guessing.

What can you do while you wait?

Keep your receipt. Keep a copy of every paper. Know your visa’s end date. That date still runs the clock.
