What happens if you overstay your visa?
You stayed past your visa in South Africa. The law says that can mean a ban. 12 months, two years, or five years. The law’s word is “may”, not “will”. We read it on 27 August 2026. And you can ask to lift a ban.
This page is for one moment. Your visa has already ended. Is your visa still valid today? Then read the still in time page instead.
What does the law say?
The rule sits in the Immigration Regulations 2014. Its name is regulation 27(3). It works with the Act’s section 30(1)(h). We read that text on 27 August 2026. We read the Act on 29 August 2026.
| How long you overstayed | The ban the law allows |
|---|---|
| 30 days or less | 12 months |
| More than 30 days | Five years |
| A second time within 24 months | Two years |
The law’s word is “may”. “May be declared undesirable.” Not “shall”. Not “will”. No text makes the ban automatic.
What is “undesirable”?
Travellers say “ban”. The law says “declared undesirable”. The two mean the same thing here. You signed Form 11 on entry. It says what a ban costs. You would not qualify for a visa. Not while the ban runs.
Who declares it? The Director-General of Home Affairs. It comes on a paper called Form 19. People report it happens at the airport. That is a report about practice. The law puts the choice with Home Affairs.
When does the clock start?
The day your visa ends. The law counts from that day. Nothing we read pauses the clock. Not an application. Not a receipt. You applied and now you wait? Read what the texts say about waiting. And: can you leave South Africa while you wait?.
Can a ban be lifted?
Yes, you can ask. Two ways are written on Form 19. One: write to the Director-General. You have 10 working days from the notice. The form gives an email address for this. Two: ask the Minister to waive the ban. The Act allows that for good cause. Its name is section 30(2). We found no numbers on outcomes. So we promise nothing.
Is there a fine?
Overstaying is an offence in the Act. Section 49(1)(a) names it. A court can give a fine. Or prison, up to two years. That happens in court, after a case. The law names no fine at the border.
Is your visa still valid today?
Then you have not overstayed. You can still apply for more time. Since 2025, visa lawyers say this: late applications are nearly always refused. The law does not say this. We have no proof a letter helps. Still in time? is it too late to apply?.
